Terms of participation in Lotus Driving School
This is a translation of the Bulgarian terms. If the two versions differ, the Bulgarian text applies.
General terms
Art. 1. These general terms govern enrolment in the courses organised by Lotus Sofia Ltd. or Lotus Sofia Motorsport Club (the Organiser) under the name Lotus Driving School, or LDS for short.
Sending a request to enrol in LDS confirms that the participant fully understands and accepts the general terms, as well as any decision taken by the supervisor and the training course.
Unless other terms are agreed in a separate written document between the Organiser and the Client, these general terms apply to registering for and taking part in every LDS course.
Schedule and prices
Art. 2.1. The announced LDS prices are in euro for end clients and include all applicable taxes and state fees. Only fully paid LDS requests guarantee the final price and the terms valid at the time of the order.
Art. 2.2. The Client alone is responsible for paying by bank transfer or bank card. The Organiser is not liable for problems with transfers of the LDS fee. A request can be confirmed only after the full amount has been received.
Art. 2.3. The Client understands that the Consumer Protection Act does not provide for a refund on withdrawal from services and events that are to take place on a specific date or within a period set in advance.
Art. 2.4. The beneficiary of an LDS gift voucher may use it to request an LDS course. Vouchers are valid for one year from the date of purchase.
Art. 2.5. A request to participate may be changed only as regards the LDS date, and only up to 30 days before the date first chosen. The Organiser reserves the right to refuse a change whatever the reasons.
Art. 2.6. The course fee covers the minimum equipment the Client needs as a driver on track (balaclava and helmet), a training car, track hire, technical and coaching support and guidance, and lunch (unless announced otherwise).
Cancellation of an event. Withdrawal
Art. 3.1. If the Organiser has to cancel an LDS event for any reason (severe weather, a blocked track, damaged cars, too few participants or other force majeure circumstances), the Client will be offered either a full refund of the fee paid or an alternative date for an LDS event.
Art. 3.2. If a participant does not attend or withdraws after a confirmed request, the services are considered delivered and no refund of the fee or other compensation is due.
Art. 3.3. For organised groups, the terms for withdrawal and cancellation are set in a separate agreement.
Conditions of participation
Art. 4.1. Each event takes place on the date and at the venue set in the LDS calendar.
Art. 4.2. The schedule of each LDS event is mandatory for the participants. Being more than 30 minutes late may be a reason not to admit the participant, as a no-show.
Art. 4.3. Each participant must be at least 18 years old and hold a valid licence to drive a car.
Art. 4.4. Each participant declares that they are in good physical and mental health and that their actions will not go against medical advice or endanger them or the other participants.
Art. 4.5. Because of the risks of driving on track, the organiser of the course may refuse participation to a trainee with a physical impairment incompatible with driving a car, with dangerous behaviour, or for any other serious and legitimate reason.
Art. 4.6. In the event of an accident with material damage, the course ends immediately for the participant, without a refund of the fees.
Art. 4.7. In the event of dangerous driving or repeated driving in the direction opposite to the one set for the track and the event, the Organiser may end the trainee’s participation in the course without a refund.
